Senate passes bill allowing deadly force in home, vehicle as self-protection

TALLAHASSEE· A bill allowing the use of deadly force during a home invasion or when individuals consider themselves threatened unanimously passed the Florida Senate on Wednesday.

The measure (SB 436) would eliminate criminal penalties for an individual who uses deadly force as self-protection in his home or vehicle and other unspecified circumstances.

The Senate passed the gun measure, supported by the National Rifle Association, on a 38-0 vote just moments after it defeated a proposal that might have cleared the way for Terri Schiavo's feeding tube to be reinserted.

We have a similar law in Utah. I think it's a good thing.

Anybody breaking into a home is pretty much assumed to be a threat. If they make any threatening move, they are at the mercy of the homeowner.

Whats funny is I always thought we had that bill in the first place???????

It extends to vehical? Does it work if you dont have a CCW permit?

When I was speaking to my Security instructor, he told me that with the "Man's (and or Womens) Castle Law"you have the right to shoot someone in your home, i f you have no other option.

He said it didnt extend to your vehical, but that was 2 weeks ago.

I guess this bill isnt exactly new, but mabe revised?

Well its a good darn thing considering I have had one in my vehicle for 15 years.......:eek:

Do you have a CCW permit Val?

Even if you didnt, all you have to do is have it unloaded, and not easly acessable.

Im still wondering how I can protect myself, with a unloaed unassesable firearm?



One thing is for sure. My blackjack is going to live in my truck.

I still think the term deadly force would have to be decided by the courts.....you know ....guilty untill proven innocent....we had one such thing ho down here...Man and his brother driving down road ( professional by trade drivers) and got ran off by a jeep with 2 men in it. Words and hand signals were exchanged then they pulled over. When the guys in the car got out, the guys in the jeep ran into the brother and knocked him for a loop....then they drove onto the sidewalk after the other guy....he pulled his legal to carry and fired into the radiator of the jeep making lots of holes in it....well they missed him on way past but the police followed the fluid trail to the house and guess who got in the trouble!.....fined for shooting within city limits.....endangering etc etc like all the things they think of when arresting someone....so if you trust the law....think again.......oh and nothing was done to the jeep drivers.....

That makes perfect sense to me.

After all I dont have the right to interperate, or enforce the law. I only can "do what I have to" to live.
If I did something stupid to put myself in such a situation, I should pay the price. Just like everyone else.

No remember the story I told you about the electricians? I carry a loaded 12 guage next to me......it is not illegal.....and its not concealed..........but I am decideding lately that is not enough....so for me to carry a gun in my purse...I think I need to get legal....the shotgun wont fit.....

I have been stopped a few times, speeding etc...no tickets though;) and the officer always ask me if the gun is loaded...my response..."nothing more useless than an unloaded gun" they just smile........

sounds like a good enough excuse to chop up an 870 pump with all kinds of cool pistol grips and such. i love those things

Again, laws vary considerably from state to state.

Our state makes a distinction between a gun that is loaded, and one that contains ammunition. It's loaded if it's an automatic, and there is a cartridge in the chamber, or if it's a revolver and one actuation of one mechanism will cause it to discharge. Otherwise, it's containing ammunition. By that rule, a Single Six is loaded only if the hammer is cocked, and a Redhawk is loaded, period.

I quite worrying about such subtleties when I got a concealed carry permit.

Trying to run somebody down with a Jeep sounds like assault with a deadly weapon to me... don't understand why the driver isn't still in the slammer.

Jeb says he will sign it. About time too. In almost all cases, where a Citizes used deadly force to protect himself/herself, the Courts have used common sense, and not pursued this in a trial.
What makes this better in real life though, is that now a Citizen is protected from overzealous, anti gun Prosecutors, like we have in abundance in South Florida.
Most of the critics of this bill were transplanted yankee liberals in Palm Beach, and Broward Counties. (Remember, its the land of the hanging chad). The same folks used the same scare tactics during the debate on Florida's CCW law. None of their 'the sky will fall' crap came to pass, and it won't with this new measure either.
